Who handles disputes referred to the arbitration court?

Arbitrators and mediators entered on the List of Arbitrators and Mediators of the Court.

Requests for an entry on the List of Arbitrators and Mediators can be addressed to the president by:

  • an individual who would like to become an arbitrator or mediator ? recommendations from two audiovisual business organisations, or from one audiovisual business organisation and from the Polish Film Institute, are required;
  • the president, vice-president or secretary general of SARA ? for these candidates a recommendation from one audiovisual business organisation or from the Polish Film Institute is required;
  • members and the management board of KIPA ? if a member of KIPA submits his or her application, his or her candidacy will have to be approved by the management board of the chamber, and the application will have to be accompanied by a recommendation from another audiovisual business organisation or from the Polish Film Institute;
  • organisations, associations, societies or chambers whose members operate on the audiovisual market, or whose statutory objective is to protect rights in intangible property ? a recommendation from another audiovisual business organisation or from the Polish Film Institute is required;
  • public institutions and business entities that mainly operate on the audiovisual market ? a recommendation from at least one audiovisual business organisation or from the Polish Film Institute is required.

    The List of Arbitrators and Mediators includes: the name and surname of an arbitrator or mediator, his or her academic degree or professional title, occupation and workplace, command of foreign languages and a description of any other qualifications and skills useful in arbitration or mediation proceedings. In addition, the list will specify whether an individual can be appointed as an arbitrator or mediator, or as only an arbitrator or only as a mediator.

    Cases are heard by three arbitrators ? two of them are appointed by the parties, and these two arbitrators appoint the third one ? the presiding arbitrator. Mediation, on the other hand, is conducted by one mediator, unless the parties agree otherwise.
